We provide this Privacy Policy to make you aware of our practices and of the choices you can make about the way your information is collected and used.
We do not collect any personally identifiable information (such as your name, address, e-mail address, phone number, etc.), unless you register as a user, enroll in a subscription, sign up for a free Service, purchase any Service, or make any kind of purchase on or through the Site. Aside from your purchase/enrollment history with us, we only collect personally identifiable information (such as name, address, email address, and phone number) that we request from you, and/or that you voluntarily provide to us. Information that is uploaded by a User when using any tools we offer, including the application tools associated with our subscription Services, is not collected per se and is permanently deleted when the User account is terminated. Any payment or banking information collected for the purpose of processing payments for Services is collected by a third-party vendor and will be stored in accordance with that vendor’s policies and procedures. Because we do not have access to such information, you should review the vendor’s applicable policies before providing your information to the vendor.
When you use our Site and/or Services we may collect tracking information such as your browser type, mobile device, the type of operating system you use, the domain name of your Internet service provider and pages visited on the Site. We may use this information for aggregate reporting. For example, we may want to know how long the average user spends on our Site or which pages or features get the most attention. We use this information to make our Site and Services more useful to you; to provide you with more effective customer service; to make the Site or Services easier to use by eliminating the need for you to repeatedly enter the same information; and to perform research and analysis aimed at improving our Services and technologies. “Non-Personal Information” is information that is not personally identifiable to you and that we automatically collect when you access our Site with a web browser. It may also include publicly available information that is shared between you and others.
TPM uses your personally identifiable information to provide the applicable Services, as well as send you notices, communications, updates, and offers. We may allow third parties, such as Google.com, to use your Non-Personal Information for marketing purposes and show you products and services in which you may have an interest. By registering with us, signing up to receive a free Service, or by purchasing any Services, you (1) are authorizing us to use your personally identifiable information to promote and market to you other products or Services related to subject matter we believe may be of interest to you, and (2) are authorizing us to use your personally identifiable information to provide the applicable Services, share your information with our third-party vendors when necessary to provide the applicable Services (such as web host for example), as well as send you notices, communications, updates, and offers.
By using the Site and/or by registering with us, signing up to receive a free Service, or by purchasing any Services, you consent to allow us, our affiliates, and/or any applicable third parties, like Google.com, to use your Non-Personal Information for any marketing purposes. We do not sell your personally identifiable information.
We may share your personally identifiable information and Non-Personal Information with related business entities, vendors, and agents when necessary to provide the applicable Services, as well as our internal marketing to you. Other than for the purpose of providing you with the Services and/or our direct marketing and advertising to you, we do not share your personal information; except, however, we may disclose your personal information (a) to any governmental authority as part of an investigation to determine our compliance with any applicable law, rule, or regulation (including privacy laws, rules, and regulations), (b) in response to a court order, subpoena, discovery request, or other lawful judicial or administrative proceeding, (c) as otherwise required or permitted under any applicable law, rule, or regulation, (d) in good faith, to protect or defend the rights or property of TPM or other users, and (e) if TPM is involved in a merger, acquisition, or sale of all or a portion of its assets.
All data provided to us and/or published on our Site is stored by TPM on its servers, and/or on the servers of our third-party vendors, located in the United States. In our sole and absolute discretion, we may permanently retain the data we collect from you. By using the Site and/or by registering with us, signing up to receive a free Service, or by purchasing any Services, you consent to our data retention policy.
Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, despite our efforts to protect your information, TPM cannot and does not ensure or warrant the security of any information you transmit to us, or to or from our online products or Services. You transmit and receive all such information at your own risk. TPM PROVIDES ANY AND ALL SERVICES AND INFORMATION ON AN “AS IS” BASIS AND GRANTS NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY. TPM SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
(A) How TPM Uses Technology to Improve Your TPM Experience
TPM uses cookies and web beacons, described below, to collect information about the pages you view, the links you click, and other actions you take on our Site. Additionally, we collect certain standard information your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses.
Most aggregate information is collected via cookies, web beacons and other technical methods. Web beacons, also known as clear gifs, in conjunction with cookies, are used to compile statistics about website usage. Web beacons are small pieces of data embedded in images on the pages of websites or applications. We or our service providers use these technical methods to analyze the traffic patterns on our website, such as the frequency with which our users visit various parts of the website and to measure site effectiveness or use of online products and services. We may also use Web beacons in HTML emails that we send our visitors who have agreed to receive emails from us, to
determine whether our recipients have opened those emails and/or clicked on links in those emails. On their own, cookies or Web beacons do not contain or reveal any personally identifiable information. However, if you choose to furnish TPM with personally identifiable information, this information can be associated to the data stored in the cookies or Web beacons. These technical methods may involve the transmission of information either directly to us or to our service providers. You may render some Web beacons unusable by rejecting their associated cookies.
We also use cookies to store, and sometimes to track, user information. Cookies, by themselves, do not tell us your email address or other personally identifiable information unless you choose to provide this information to us by, for example, registering or subscribing to our Site. A cookie is a small amount of data that is sent to your browser from a Web server and stored on your computer’s hard drive. A cookie contains a unique number that allows our website to recognize your computer. We use both temporary and persistent cookies; a temporary cookie tracks visitor activity during a session or visit and it expires when you close your browser. We use them to provide continuity for your visit as you visit website pages. Persistent cookies allow us to keep track of your user name and password (if you are a subscriber) so you do not have to re-enter that information each time you visit. The Help function on most browsers contains information on how to set your browser to notify you before accepting cookies or to disable cookies entirely. However, if you do not accept cookies, you will not be able to take advantage of various features on our website that are available to other visitors.
TPM wants to ensure you understand that accepting a cookie in no way gives us access to your computer or any personal information about you, other than the data you choose to share with us. We are aware many people have concerns about cookies; however, we believe the benefit we both gain from their proper use is worthwhile.
(B) Links to Third Party Websites
Links to third party websites are provided solely as a convenience to you. If you use these links you will leave the Site. TPM has not comprehensively reviewed these third-party websites and does not control and is not responsible for any of these websites, their content, or their privacy policies. Thus, TPM does not make any representations about them, or any information, software or other products or materials found there or any results that may be obtained from using them. If you decide to access any of the third-party websites linked to our Site, you do this entirely at your own risk.
Persons who are under 18 years old may not register with the Site, use any Services offered by or through the Site that require personal information as a condition of use, or provide any information to us.
If there are updates to this Privacy Policy, we will post the revision date above.
As someone who resides in the European Union, you may be entitled to exercise certain rights that you are given under the General Data Protection Regulation (GDPR).
Any information or data that you choose to provide us will be kept with TPM until one of these happens: (1) you ask TPM to DELETE the information and/or data, (2) TPM decides to STOP USING the existing data processors, or (3) TPM decides that the cost of retaining the data outweighs the value in retaining it.
As a person who is located in the European Union region, you may have the right to request access to the data that TPM collected about you and stores. Keep in mind that some parts of this data were provided by you personally, while others were gathered through cookies and pixels.
You may have the right to withdraw consent to the data that you previously gave us to collect and process. The right to withdraw consent applies to any future processing of that data. However, any data that has been collected and processed previously based on valid consent is lawful and not subject to liability based on any legal grounds.
You may also have the right to request the erasure of your data and all your information from TPM’s data storage. Once you request that your data be erased from TPM’s databases, we have thirty (30) days to comply with your request. If it’s impossible to comply within 30 days, then we will respond to your request, let you know about the issue and give you a reasonable time as to when your request for deletion will be honored.
Aside from rights such as a request to access, request to delete, and rectify, an EU user may also have the right to place restrictions on the data processing itself. This means you may be able to limit certain things that TPM can and cannot do with your data. You can choose to limit the transfer of your data to third-party businesses, unless it’s essential for TPM’s basic functions. However, we do not transfer your personal information to third parties unless it’s essential.
You may also have the right to file a complaint with a supervisory authority that oversees and handles issues related to the GDPR.
Lastly, we only require information that is reasonably necessary to perform our Agreement with you. We do not collect any unnecessary data, and any information we acquire is used for legitimate business purposes, such as growing and scaling our business or being able to provide satisfactory customer service to you and other users.
